DEFINITION OF TRADEMARK AS PER FEDERAL LAW / TRADEMARK LAW

Trademark are words, logo, names, slogans, signatures, letters, figures, color, software, application, website, shape, or a combination of all of these. The United Arab Emirate’s Federal Laws provide protection for the registered trademarks. The trademark law intended to safeguard the interests of both consumers and business in U.A.E. Trademark Laws cover the following main areas:

TRADEMARK VALIDITY

Registered trademarks in the United Arab Emirates are valid for 10 years and start with the filing date. The registration is renewable for periods of 10 years. Omnis can also automatically provide you with reminders and keep you up to date on your status after you file your trademark application.

TRADEMARK APPLICATION PROCESS

At Omnis we believe in transparency in our services, So clients, should know how the process of registering a trademark. Here is the procedure of registering a trademark in the UAE.

The trademark application for registration is filed at the Ministry of Economy

1. Within 30 days from the day of submission application Ministry of Economy gives its decision

2. If everything fine the Ministry of Economy approves your Trade Mark, it shall be announced in its bulletin and in two Arabic newspapers before the starting registration process on applicant expense.

3. Any interested person can file an objection to the registration of the trademark by submitting a written objection to the Ministry of Economy within 30 days from the date of the last announcement. If anyone files an objection, the Ministry of Economy notifies the applicant with a copy of the objection to his application within 15 days from the receipt of such an objection.

4. If no objection is raised from anyone then the registration is finalized. Ministry of Economy provides the Trademark certificate which containing details of:

1. trademark registration number;

2. date of application and registration;

3. trade name or the owner’s name, nationality, and place of residence

4. copy of the trademark; and

5. description of the products, goods, or services that come under the trademark.

The estimated timeframe for the registration of a trademark in the UAE is between 2 to 3 months. The actual timeframe will depend upon the facts of each application for registration.

Documents Required for Trademark Registration

The information and documents required for filing the application are:

1. A Notarized Power of Attorney in favor of Omnis. ( If from foreign company, it must be legalized upto UAE Consulate ).

1. Emirates ID / Passport Copy of the Managing Director.

2. A copy of Company trade license.

3. A good representation of the Mark / trademark logo PDF or JPG format.

4. List of goods / services to identify from which classifications it belongs.
